Although the overall review process is the Local Authority’s responsibility, it is usual practice for Steps 1 to 4 to be delegated by the Local Authority to the school/setting/or other education provider. (SEND Code of Practice 9.173-9.175) 

Step 1
  • Obtain advice and information about the child and young person from all the relevant professionals and the parent and the child or young person themselves.

Step 2
  • Circulate the reports received along with the invitations to attend the annual review meeting. (SEND Code of Practice 9.176)

Step 3
  • The annual review meeting will consider:
    1. The child or young person's progress towards achieving the outcomes specified in their Education Health and Care Plan. 
    2. Whether the outcomes still remain appropriate. 
    3. If their aspirations have changed. 
    4. Review and set new short term targets
    5. Whether any changes need to be made to the provision including if the placement is still appropriate. 
  • Year 9 annual review must also include preparation for adulthood discussions. 
  • (SEND Code of Practice 9.166 to 9.168 and section 19 principles)

    2 weeks.

Step 4
  • Following the meeting the school / setting must prepare a report that includes recommendations for amendments to the Education Health and Care Plan including details where views differ, including reports / evidence to support any recommended changes to be considered. This must be sent to everyone invited to the meeting within 2 weeks including the Local authority. 

    2 weeks.

Step 5
  • The local authority has 2 weeks (4 weeks from the date of the review meeting) to decide to leave the plan unchanged, amend or cease (9.199-9.210) it and inform the parent, the young person and the school / setting of its decision.

Annual Review Quality Standards:

Education Health and Care Plan Quality Standards have been developed to support the continued improvement of the quality of assessment for children and young people who are going through the annual review process. The Quality Assurance Framework has been implemented to promote consistency across Staffordshire and improvement quality in the preparing and issuing of the Education Health and Care Plan.
