All schools are responsible for providing a broad, balanced and inclusive curriculum for all pupils and in particular for pupils with a special educational need or disability.
The local authority has a duty to ensure that schools:
- Increase the extent to which disabled pupils can participate in the school curriculum
- Improve the physical environment of schools for the purpose of increasing the extent to which disabled pupils are able to take advantage of education and benefits, facilities or services provided or offered by the schools
- Improve the delivery of information to disabled pupils which is readily accessible to pupils who are not disabled
The Equality Act 2010 makes discrimination against disabled individuals unlawful in respect to their access to education. For the purpose of this act, an individual with a disability is one who has a physical or mental impairment which has a substantial and long term (at least twelve months) adverse effect on his/her ability to carry out normal day to day activities. The Act uses a wide definition of disability and may include those with physical or mobility impairments and medical conditions.
The Act makes it unlawful for schools to discriminate against a pupil with a disability. Discrimination can take place in two ways:
- treating a pupil less favourably for a reason relating to his/her disability
- failing to make reasonable adjustments to ensure disabled pupils are not placed at a substantial disadvantage.
